Letter to chase a council that has missed an EHCP deadline

On this page

Use this letter when the council has missed a legal deadline, such as the 6-week decision or the 20-week final plan.

In short

  • Check the exact deadline first with our deadline checker.
  • Send it to the person handling your child’s case, and copy in the SEN team’s main email.
  • Ask for a reply within 5 working days. If nothing changes, make a formal complaint.

Before you send it

  • Work out which deadline was missed and the date it fell on.
  • Find the name of the person handling your child’s case, if you know it.
  • Keep a note of every email and call so far, with dates.

  • The council received my request for an EHC needs assessment on [date]. Under regulation 13 of the SEND Regulations 2014, the final EHC plan should have been issued by [date], 20 weeks later.
  • [Child’s name]’s annual review meeting took place on [date]. Under regulation 20 of the SEND Regulations 2014, the council should have told me its decision by [date], 4 weeks after the meeting.

Yours sincerely,

[Your full name]
